Brazil: Court orders Itapemirim to settle wage dispute

The court issued an order for Itapemirim Transportes Aéreos to settle salaries and back payments to the FGTS (Fundo de Garantia do Tempo de Serviço), a kind of unemployment insurance.

The Brazilian Labor Court reconsidered the request made by the National Aeronautics Union (SNA) and granted an injunction with a request for attachment in the proceeding against Itapemirim Transportes Aéreos dealing with the settlement in salary payments and FGTS deposits of flight attendants.

The court decision granted the request, which consists of the seizure of almost US$ 200,000 from the company’s account as a precautionary measure, intended to ensure the cancellation of the arrears.

Allegations of FGTS payment delays have existed since before the company suspended its activities in December 2021. In an earlier decision, the court had denied an urgent request.

As reported by our Brazilian partner media Aeroin, SNA has 3 lawsuits imposed against ITA for salary arrears, delay in the payment of per diems, and meal coupons, in addition to the lack of deposit of the FGTS.
