The Colombian Transportation Superintendence initiated an investigation against Ultra Air. The proceedings were initiated after Avianca denounced -at the end of March- the offering of flights without having the corresponding slots assigned to operate them.
According to El Tiempo, last Thursday, May 5, the Superintendence of Transportation issued resolution 1419, which indicates the opening of the investigation of two conducts of the airline.
The first of these investigations will focus on the alleged dissemination of misleading advertising. This is prohibited by the consumer statute. According to the resolution, Ultra Air would have misled the users of the transport service with the announcement -on social networks- of the authorized destinations, when it did not yet have the permit to operate them. The second conduct is the alleged failure to comply with the conditions under which information must be provided to users.

«Ultra Air S.A.S. would have provided on its website information on the sale of flights that would not correspond to the reality of the service offered,» reads one of the recitals of the resolution. According to the body, the airline would have provided information that is not real to users. Since it did not have the necessary slots at the time of the offer, it could not provide the service under the terms offered.
The fine to be applied, in case the first charge is proven, would amount to up to two billion pesos (around US$ 487,000). For the second charge, the fine would be around 420 million pesos (just over one hundred thousand dollars).
Ultra Air responded to an inquiry made by Aviacionline stating that for the moment it will not make any statements on the matter as it is subject to internal review.
