The National Civil Aviation Agency (ANAC) announced that it has taken an important step towards making Brazilian aviation more sustainable. The agency unanimously approved, in a Board of Directors meeting held last Tuesday, May 14, a resolution regulating the monitoring and compensation of carbon dioxide (CO₂) emissions in international flights. The new rules will take effect on January 1, 2025.
The issue was under public consultation from October 19, 2023, to January 10, 2024, and received 15 contributions, of which four were accepted.
The regulation incorporates into Brazilian law the Carbon Offsetting and Reduction Scheme for International Aviation (Corsia). Brazil is a signatory to this mechanism, which was approved in 2016 by the International Civil Aviation Organization (ICAO).
According to ANAC, Corsia aims to offset – from 2024 to 2035 – emissions from international aviation that exceed 85% of the levels recorded in 2019, without compromising the growth of the sector. However, routes involving Brazil will only count for compensation purposes starting in 2027.
The resolution defines the requirements for monitoring, reporting, and verifying CO₂ emissions and calculating the compensation obligations of air operators. An ordinance, to be published by ANAC, will establish the form and procedures for meeting these emissions monitoring requirements. The Agency will also be responsible for receiving carbon emission data from air operators.
The air operator must monitor its CO₂ emissions when it emits, in a calendar year, an amount exceeding ten thousand tons in international flight stages, using fixed-wing aircraft with a maximum certified takeoff weight above 5,700 kg.
Compensation will be calculated based on the international flight stages carried out between Corsia participating countries and the combination of sectoral and individual growth factors. Those who do not comply with the determinations will be subject to a fine.
