U.S. government demands forfeiture of Iranian-tied Boeing 747-300M held at Ezeiza airport

Through a request filed by the U.S. Attorney’s Office in the U.S. District Court for the District of Columbia, the U.S. government formally requested the forfeiture in rem of the Boeing 747-300M owned and operated by EMTRASUR and previously operated by Mahan Air and held at Ezeiza Airport, Argentina.

The complaint states that the forfeiture action arises from a joint FBI and Commerce Department investigation into the illegal transfer of the aircraft with registration number YV-3531 and Serial Number 23413 (an asset under its authority subject to export controls) from a sanctioned Iranian entity to a third party without authorization from the U.S. government.

The transfer conflicts with a Temporary Denial Order (TDO) against Mahan Air for the addition of six U.S.-origin aircraft without U.S. government authorization.

The TDO, in its successive renewals – the latest in May 2022 – prohibits Mahan Air (or anyone directly or indirectly related to the Iranian operator) from engaging in transactions in connection with these aircraft.

The investigation proves that in October 2021 Mahan Air transferred the aircraft in question to EMTRASUR through a United Arab Emirates company, Lance Tech General Trading LLC, after payment of €8 million.
