The court suspends LATAM's payment of 6 million dollars to Voepass
The measure was adopted while the dispute over the debt, which involves a request for a "pre-judicial collection," continues to be processed under secrecy
A preliminary decision issued by the São Paulo Court of Justice granted LATAM a reprieve from a court order that would have required it to pay approximately $6 million to Voepass.
The measure was taken while the debt dispute, filed as a request for “pre-litigation collection”, continues to be processed under seal. In its defense, LATAM argued that, contrary to Voepass’ claims, the airline is in fact a creditor, not a debtor. According to the company, the conflict was already being resolved through arbitration before Voepass turned to the courts to collect the amount.
The dispute stems from an agreement between the two companies for regional routes, in which Voepass would operate the route and LATAM would have exclusive rights to sell it, including the combination of routes operated by the company itself, our partner outlet Aeroin reported.
On January 28, months after the crash of Flight 2283, LATAM decided to terminate its agreements with Voepass, offering to pay $4.4 million per month for six months as compensation. Less than a week later, Voepass filed a request for early judicial recovery.
LATAM made the payments for February and March, but stopped the transfers after ANAC suspended Voepass operations ten days ago.
In addition to the payments for the past two months, LATAM claims it advanced $700,000 immediately after the Vinhedo accident, and contributed nearly $1 million more to cover the insurance policy for its customers who were on board the ATR 72 that crashed.
In an official statement, LATAM justified the termination of its capacity and codeshare agreements on the basis of "just cause". The company also emphasized that since the August 2024 accident, it has already settled all the aircraft usage hours effectively made available by Voepass.
